This Privacy Notice describes how Infusion Marketing Group, LLC d/b/a OptimaFI (“OptimaFI,” “we,” “us,” or “our”) processes personal information in connection with the provision of the services and software made available by OptimaFI to its customers (“Services”). Our Services are intended solely for professional users acting on behalf of businesses, including financial institutions.

We process personal information, including nonpublic personal information where applicable, only as necessary to provide services to and on behalf of financial institutions, including banks and credit unions, and as permitted by applicable law. We do not sell personal information as defined under applicable privacy laws and do not use personal information for our own independent marketing or advertising purposes.

We collect personal information when our customers and authorized users use the Services, communicate with us, or provide information in connection with the Services we perform on their behalf.

We may collect personal information provided in connection with the Services, including:

  • Contact and account information
  • Communications and support information
  • Information provided in connection with service delivery, analytics, and reporting.

Information automatically collected.

We automatically collect certain information when the services are accessed or used. This may include Internet Protocol (IP) address, browser and device details, operating system, language preferences, referring URLs, device name, country, general location, and information about how and when the Services are used.

This information is collected to support the security, functionality, and performance of the Services, as well as analytics and reporting.  We may use cookies and similar technologies in connection with these purposes.

2. How do we process personal information?

We process personal information to provide, operate, and support the Services for financial institutions, including account management, support, security, fraud prevention, and compliance with legal obligations. We may also use de-identified or aggregated data derived from the Services for analytics, benchmarking, and product improvement. Such data does not identify you or any individual and is not subject to deletion obligations under applicable privacy laws.

Our customers are responsible for ensuring that their use of the Services, including the data they provide, complies with applicable law.

3. When and with whom do we share your personal information?

We may share personal information with service providers that support the delivery, operation, security, and performance of the Services. These parties are authorized to use personal information only as necessary to provide services in support of the Services and are subject to contractual obligations regarding confidentiality, data use, and security. We do not permit them to use personal information for their own independent purposes.

We may also disclose personal information where required by law, to respond to lawful requests, to protect our rights or the security of the Services, or in connection with a merger, sale, financing, or similar transactions.

4. Do we use cookies and other tracking technologies?

We and our service providers use cookies, pixels, tags, and similar technologies to support the operation, security, and performance of the Services.

5. Where is personal information processed?

Personal information is primarily processed and stored in the United States. To the extent service providers process personal information outside the United States, we implement appropriate safeguards consistent with applicable law and industry standards.

6. How long do we keep your information?

We retain personal information only as long as necessary to provide the Services and comply with legal obligations. When personal information is no longer required, we will delete, anonymize, or securely isolate it as appropriate. We may retain de-identified or aggregated data beyond the term of the service relationship for internal business purposes.

7. Data security and breach notification.

We implement and maintain administrative, technical, and physical safeguards designed to protect the security, confidentiality, and integrity of personal information processed in connection with the Services, appropriate to its sensitivity. Upon request and subject to confidentiality obligations, we will make available relevant information regarding our security program, including summaries of independent security assessments (such as SOC 2 reports). In the event of a confirmed unauthorized access to or acquisition of personal information that poses a risk of harm, we will notify affected customers without undue delay, and in no event later than seventy-two (72) hours after becoming aware of the incident, and will provide reasonably available information regarding the nature of the incident, the data impacted, and steps taken to investigate and mitigate the breach.

8. What privacy rights apply?

Depending on applicable law, individuals may have rights to access, correct, or delete their personal information, or to opt out of certain processing. For example, California residents may have rights under the California Consumer Privacy Act (CCPA/CPRA), and individuals whose information is subject to GLBA may have rights under applicable financial privacy regulations. Requests may be submitted using the contact information below, and we will respond in accordance with applicable legal requirements. We will not discriminate against individuals for exercising applicable privacy rights.

We may update this Privacy Notice from time to time by revising the “Last Updated” date above. If we make material changes, we may provide additional notice where appropriate.
